GENERAL

1. CKD Galbraith act only as agents only for the owners of properties and/or sport featured in this brochure. The hiring contract ( the let) is between the Hirer and the owner.

2. Once a booking is confirmed (on receipt of deposit from the Hirer) the Hirer becomes liable for the full balance of charges which are payable eight weeks prior to the commencement date of the let. Non-payment of hire charges and non receipt of the signed Tenancy Agreement by the due date will result in the agency treating the property as being available for re-booking and under no circumstances will the hirer be granted occupation of the subjects of let.

3. If the Hirer cancels a confirmed booking he/she remains liable for payment of the full cost of the let. Upon receipt of written confirmation of the cancellation from the Hirer, the Agency will endeavour to re-let the property and if successful will make a full refund to the Hirer less an administration fee of £105 (inclusive of VAT) and any other expenses incurred in re-letting. It may not be possible to re-let the booking, in which case there will be no refund. It is often only possible to re-let sport at short notice at a reduced rate, in such cases the shortfall will be deducted and the balance returned.

4. We recommend that clients insure against cancellation since if the sport and/or accommodation is not re-let all payments made will be forfeited and any balances will remain due. Please ask for further details.

5. The number of persons occupying a property must not exceed the maximum occupancy level stated in the brochure. Owners reserve the right to terminate occupancy of the property without notice or refund or make an additional charge in the case of a breach of this condition.

6. The Hirer is responsible for the condition of the property and its entire contents during the period of the let hire period, fair wear and tear excepted. The Hirer will make good any damage or loss and leave the property and contents in clean and tidy condition. The person held to be responsible for the hiring party will be the person who signed the tenancy agreement.

7. Owners reserve the right to decline to hand over properties to any person or persons who in their opinion is not suitable to take charge. In such cases, hire charges shall be refunded in full and the liability of the owner shall cease. If an owner is prevented, because of circumstances outwith his control, (e.g. fire damage, drought or the interruption of utility supplies), from putting his property at the disposal of the Hirer, the hire charge shall be refunded in full but the Hirer shall have no further claim against the owner.

8. The contract effected between the Hirer and the owner of the property is in terms of Schedule 4 Section 8 of the Housing (Scotland) Act 1988 and confers on the Hirer the right to occupy the property for the period agreed for holiday purposes only.

9. CKD Galbraith have taken every care to ensure the accuracy of property descriptions and all information is given in good faith and believed correct at the time of going to press, but they cannot be held responsible for changes beyond their control or be liable for any act, neglect or default on the part of the owner resulting in loss, injury or accident caused to the Hirer.

10. All sportsmen must have third party insurance against sporting accidents.

11. All instructions and decisions given by stalkers, keepers and ghillies will be final and must be followed. Failure to comply with such instructions or decisions may result in the cancellation of the rest of the tenancy. In the event of cancellation under the terms of this clause, there will be no right to a refund or compensation.

12. All sportsmen will be required to hold appropriate licences and certificates for the legal use of sporting weapons. Application forms can be provided upon request. All sportsmen will comply with all relevant legislation and in particular will not use lead shot when shooting over wetlands.

13. Where required it may be a condition of the tenancy that sporting returns of the game taken be made to CKD Galbraith. Failure to make a return within the time frame specified may result in forfeiture of the opportunity for future sport.

BOOKINGS

1. Once a let has been agreed it will be provisionally reserved in your name and an invoice for 50% of the rental will be despatched. Payment should be made to CKD Galbraith within 14 days to confirm the booking.

2. The final invoice will be sent 12 weeks prior to the commencement of the tenancy, and must be settled within 4 weeks.

3. When a booking is made less than 12 weeks prior to the commencement of the intended tenancy the total rental will be due within 14 days to confirm the booking.

4. When a booking is made less than 8 weeks prior to the intended tenancy the total rental will be due immediately on receipt of the invoice.

5. Failure to comply with items 1 - 4 could lead to cancellation of the booking and CKD Galbraith reserve the right to re-let without further notice.

6. It is our policy, wherever possible, to offer existing tenants first refusal of any sport or accommodation they have taken. If we have not received a provisional indication from you for the following year by 30th November, we cannot guarantee availability.

PAYMENTS

Payments may be made by any of the following: a) Directly from bank to bank with funds being sent to:- CKD Galbraith Sporting Clients Account, Bank of Scotland, 2-6 Eastgate, Inverness IV2 3NA. Account No. 00306318 Sort Code 80-91-26. IBAN GB61 BOFS 8091 2600 3063 18 SWIFT BIC BOFSGB21125 b) By cheque drawn on a UK bank account made payable to "CKD Galbraith"c) By banker's draft d) By credit card (Mastercard/Visa) or debit card (Switch). Please note that all payments must be made in a negotiable Sterling instrument. Bank charges arising from the transfer of funds will be payable by the tenant.

WATER SUPPLIES

In many areas of rural Scotland water is by private supply which comes from peaty ground and, even when it comes from a mains supply, can be brown. This is especially noticeable after heavy rainfall. Although unsightly, historically it has been safe to drink. However, for peace of mind you may prefer to boil water for drinking or purchase bottled water.

RISK ASSESSMENTS

Risk Assessments for all the major sporting activities are posted on our sporting website www.sportinglets.co.uk and all those engaging in these sporting activities must have read the relevant Risk Assessments prior to the commencement of their tenancy.

CKD GALBRAITH POLICY

On all UK sport CKD Galbraith act as true prime agents. Sport is not rented and then sub-let, which in certain circumstances could be construed as acting in competition with retained estates. CKD Galbraith are retained by estates to let sport on their behalf. CKD Galbraith are governed by the rules concerning client funds laid down by the Royal Institution of Chartered Surveyors and all monies received are paid through our dedicated sporting clients' account.

COMPLAINTS

It is important to the property owner and CKD Galbraith that tenants enjoy their holiday and every effort is made to ensure this. However, in the unlikely event of dissatisfaction with the property or sport on the estate, the tenant must ensure the housekeeper or sporting staff are advised immediately, so that the opportunity to rectify the problem is given.

ALL PRICES QUOTED ARE INCLUSIVE OF AGENCY COMMISSION AND VAT, WHERE APPLICABLE.

PLEASE NOTE THAT, IF WE HAVE NOT RECEIVED CLEARED FUNDS PRIOR TO THE COMMENCEMENT OF THE TENANCY, ENTRY TO THE ESTATE WILL BE REFUSED.
